Why three years
A refund claim has a deadline. Under Internal Revenue Code section 6511 it must be filed within three years of the return or two years of paying the tax, whichever is later. A fourth year back is usually a closed year, and nothing can be recovered from it. That is the only reason the number is three.
What we look for
Income sourced to the wrong state
Performance and game days allocated to the states where the work happened, and the resident credit for tax paid elsewhere actually claimed.
An entity election never made
A loan out or practice operating without the election it should have, or with a salary split never tested against comparable data.
Retirement capacity left unused
Contribution room the income supported and the return does not show, where the year is still open to it.
Equipment and depreciation
Assets expensed in the wrong year, missed entirely, or placed in service on a date the records do not support.
The deduction computed wrong
Qualified business income limited, phased or classified incorrectly, which is one of the most common errors on a high income return.
Returns and notices outstanding
A year unfiled, a notice unanswered, or an examination open. These come first, before anything else is worth discussing.
